Damit eng verbunden ist die Google-Markenbeschwerde, die ein Markeninhaber nutzen kann, um gegen die Verwendung seines Zeichens als Keyword vorzugehen. Lennart v. Scheel zeigt die Rechtsschutzmöglichkeiten auf, die für einen Werbetreibenden bestehen, wenn ein Anbieter wie Google im Rahmen einer Markenbeschwerde die Verwendung eines Keywords untersagt. Im Mittelpunkt steht dabei der Tatbestand der gezielten Behinderung gemäß 4 Nr. 4 UWG und die Frage, ob sich die Fallgruppe der unberechtigten Schutzrechtsverwarnung auf die Fälle der Markenbeschwerde übertragen lässt. Dabei wird das komplexe Dreipersonenverhältnis zwischen Werbetreibendem, Markeninhaber und Google als Intermediär beleuchtet.
